　 关于部分困难企业情况的报告

　州委：

　根据州委的安排和要求，州总工会和州经贸局分别组成了调研组，到部分破产、改制和困难企业进行了调研。现将调研的情况报告如下：

　一、反映较为突出的问题

　1、改制、破产企业多数职工反映，企业改制、破产支付给职工的经济补偿金较低，除了正常退休和内退职工外，企业一次性安置的那部分职工人均所得补偿金约2.5万元左右。这部分职工绝大多数是“4050”人员，上有老下有小，且家庭经济状况比较困难，文化偏低、技能单一，不好再就业，担心以后的生活和出路，感到十分忧虑。

　2、下岗职工、失业人员再就业和再创业难。由于社会所能提供的就业岗位远低于就业人口的增长，失业人员、下岗职工，特别是“4050”人员多数因年龄偏大、文化不高、技能单一或没有技术，脑力劳动不行，重体力劳动又干不了，还要面对农民工的竞争，因而难以找到稳定的职业。

　3、职工群众普遍关注企业在改制、破产中如何清偿历年拖欠的各种费用。改制、破产企业普遍存在拖欠职工工资、医药费、下岗职工生活费等问题，其中一些国有老企业长期处于困境，拖欠职工工资、医药费的问题尤为突出。如剑江化肥厂拖欠职工工资达1800万元，欠职工医药费达800万元；东方机床厂拖欠职工工资1300万元，欠医药费275万元。

　4、随着社会收入差距的加大，职工思想产生严重的失落感和心里不平衡。普遍反映近几年来国有优势行业的工资不断增加，职工收入较高，而绝大多数国有企业职工长期靠较低的工资和基本生活费维持生活，加之在企业改革、改制的过程中，遇到的一些具体问题和困难得不到及时的解决，因而思想上产生不满情绪。

　二、近期职工群众上访的几个主要原因

　从近期我们接待职工群众来信来访反映的问题来看，造成劳动纠纷和职工群众上上主要原因是：

　1、有的企业领导面对企业所处的困境，没有很好的依靠广大职工出主意、想办法，重大决策不提交职代会审议，又不给职工解释清楚，忽视了做职工的思想工作，使职工对企业领导产生不满。

　2、有的企业领导对政府的改革、改制政策、规定和措施，事前不给职工交底，改革、改制方案不与职工见面，职工认为领导在暗箱操作，有的职工甚至认为领导在欺骗他们，导致职工的情绪不稳定。

　3、企业在改革、改制过程中，职工提出的一些具体问题和遇到的一些具体困难，得不到企业领导很好的解释和解决，造成职工与企业领导情绪对立。

　4、因企业长期困难而拖欠职工的各种费用，在改制过程中没能得到很好的清偿，引起职工不断集体上访要求解决。

　5、部分企业在改制过程中审议改制方案和职工安置方案的程序不够规范，没有严格按照《全民所有制职工代表大会条例》审议通过职工安置方案，部分职工对安置方案不满，提出审议程序不合法，不认可，且不断到有关部门上访。影响企业的经济效益，同时也影响企业的发展，有时造成生产不正常。

　三、几点建议

　1、高度重视，认真对待，解决好再就业和再创业的问题。各级政府和有关部门要加大对下岗企业和失业人员的培训，认真落实各项帮扶政策，真正给他们创建一个再就业和再创业的平台。让职工看到希望，增强他们战胜困难的信心和决心。

　2、政府有关部门对国有改制、破产企业，要尽可能给予更多的扶持和政策上优惠，帮助企业有效地解决破产和改制中存在的问题，充分体现职工利益优先的原则，在安置补偿方面给予职工更多的倾斜，用好用足有关职工安置补偿政策。在改制、破产政策的执行和尺度的把握上，做到同属企业一样，避免事后职工相互攀比，不留后遗症。

　3、进一步完善社会保障制度，特别是加快医疗保险制度的建立和完善。企业拖欠职工医药费的情况，是职工反映较为强烈的问题之一，给职工生活带来较大的压力，政府应进一步完善社会保障制度，加快医疗保险制度的建立和完善。特别是在企业改制、破产时应将职工医疗保险费纳入改制成本，以解决职工的实际困难和后顾之忧。
