　 “严打”整治斗争阶段性自查情况汇报

　 从去年四月份党中央作出在全国范围内开展“严打”整治斗争的决定以来，我院全体干警以江总书记“5.31”重要讲话和“三个代表”要求为指针，深入贯彻全国、全省社会治安工作会议和政法工作会议精神，正确分析“严打”整治斗争形势，认真查找工作中的薄弱环节和存在的问题，进一步把“严打”整治斗争推向深入，取得了阶段性成果，现将“严打”整治斗争开展以来的情况进行一次自查，汇报如下：

　 一、认真开展“严打”整治斗争

　 “全国社会治安工作会议”以后，我院认真传达贯彻会议精神，使全院干警认识到开展“严打”整治斗争的紧迫性，增强自身的责任感，通过“严打”整治斗争，能有效遏制犯罪，打击犯罪分子的嚣张气焰。经统计，从去年四月份至今年八月份，我院办结各类刑事案件461件，结案数比去年有大幅上升。期间共处理刑事被告人540名，其中被判处十年以上有期徒刑15名，被判处五年以上十年以下有期徒刑42名，被判处五年以下有期徒刑336名，拘役28名，被判处有期徒刑、拘役缓刑105名，管制5名，单处罚金8名，予以刑事处罚1名。这些案件中涉黑案件1件，利用邪教犯罪的1件，严重暴力犯罪案件68件，多发性犯罪案件63件，严重影响社会安全的案件12件。我院在开展“严打”整治斗争中主要的做法和体会有以下几点：

　 1、统一思想，切实加强领导。我院先后召开了院党组会、院务会和全院干警动员大会，认真学习江泽民总书记和朱钅容 基总理以及最高院肖扬院长等领导同志重要讲话精神，传达贯彻中院“严打”整治斗争工作会议及区委社会治安工作会议精神，成立以院长为组长，分管副院长为副组长的“严打”领导小组，领导小组不定期的召开会议，分析、研究布置“严打”工作，保证“严打”整治斗争有条不紊的开展。“严打”整治斗争不仅仅事关刑庭一个部门，全院干警都投身到这项工作当中。当前我区的治安形势总体形势上较好，但近年刑事案件有上升的趋势，杀人、抢劫等严重暴力性犯罪不断，入户盗窃、贩毒等严惩影响人民群众安全感及生活安定的犯罪活动日益猖獗，涉嫌地方黑社会性质组织犯罪和流氓恶势力犯罪也开始出现，因而院党组要求全院干警消除思想顾虑，克服松懈厌战情绪，增强干警的紧迫感和责任感，统一思想、统一认识，全身心投入到“严打”整治斗争中。

　 2、充实力量、加快办案速度。为确保“严打”整治斗争工作的顺利开展，及时调整充实刑事审判力量，在我院各项审判任务较重，审判力量相对不足的情况下，为刑庭新增一名副庭长、一名速录员，加强了刑事审判力量，同时在物质上对刑事审判工作给予充分保障，在经费极为困难的情况，新给刑庭配备囚车。同时加快办案速度，抓紧清理未结案，迎接“严打”高潮的到来。对“严打”前的未结案，采取定人员、定案件、定质量、定时间的措施，责任到人，及时清理。对于“严打”集中统一行动中移送过来的案件，按照从快要求，加快工作节奏，缩短办案周期，决不在审判环节上拖“严打”斗争的后腿。并根据具体情况，急案急办，特案特办，对可适用简易程序的，尽量适用简易程序，如对胡礼珍盗窃一案的审理，仅用四天时间就审结了该案，取得了较好的效果。在第一阶段“严打”的二个月中，共办结刑事案件79件，处理被告人74人，平均审结期限21.6天，比去年同期有了明显缩短。

　 3、依靠党委、人大、政府，公检法三家联动。“严打”整治斗争也是一项系统工程，需要各部门的配合和支持。要营造良好的“严打”氛围，仅靠法院一家是远远不够的，必须得到党委、人大、政府的重视和支持，才能形成齐抓共管的局面。我们就“严打”工作情况、存在的问题和困难向区委、区人大常委会作了汇报，取得了党委和政府部门的大力支持，专门拔出专项资金20万元用于“严打”整治斗争。同时采取积极措施加强公、检、法的联系，形成一种三家联动的氛围，共同营造严打声势，壮大严打声威，召开了三次公开宣判大会，对6案16被告人进行公开宣判。并推出了公、检、法三家联席会议制度，相互通报在执法过程中遇到的情况和问题，研讨完善刑事办案程序中遇到的具体问题，并对一些重大、疑难案件适用法律进行研讨，三家相互支持、相互配合，提高办案质量，准确有力地打击刑事犯罪。

　 4、突出重点，加大打击力度。我院把涉黑案件、故意伤害、抢劫和盗窃、贩毒等严重暴力犯罪、严重影响群众安全感的多发性犯罪列为打击的重点，运用法律武器从重、从快地严惩了一批刑事犯罪分子。如在审理公安部督办的王国祥等12名被告人涉嫌黑社会性质组织犯罪案件中，由刑事审判的骨干力量组成合议庭，对事实和证据进行认真的审查和核实，分别按照各自所犯的罪行判处一年六个月和八年六个月不等的有期徒刑，使群众拍手称快，取得良好的社会效果。对那些顶风作案、情节恶劣、严惩危害社会和人民群众安全感的暴力犯罪和多发性犯罪，坚持在法定刑内从重处理，如张燕盗窃、破坏电力设备罪一案，被告人作案二十余次，盗窃数额达14余万元，造成极恶劣的社会影响，我院在查清事实的情况下，在法定刑内从重做出处罚，判处有期徒刑十七年，剥夺政法权利三年，并处罚金20000元。以“快、重、准、威”为切入点，全体干警以高度的责任感审理好每一件案件，没有丝毫的懈怠和马虎，正确处理好从重从快与办案质量的关系。

　 5、建章立制，提高审判人员素质。我院针对“严打”工作的现状，尽最大努力挖掘内部潜力，通过加强队伍建设，健全各项制度，强化科学管理，切实提高刑事审判人员的执法水平。坚持每周半天的业务学习制度，不断更新法律专业知识，提高审判业务素质，准确运用法律法规和有关司法解释，做到案件事实不清、证据未形成索链的，不轻率下判，犯罪性质不明，形态不清的不轻率下判；实行疑难案件集体讨论制度，加强合议庭之间的联系，遇到疑难案件，集体讨论，以求得案件的准确定性、量刑；推行审判长独任审判员责任制，界定审判长、独任审判员的职责范围，严格执行错案追究制度，强化审判人员的质量意识和责任意识，做到案件质量层层把关；落实案件催办、督办制度，要求审判人员审理每件案件做到不拖、不搁，由庭长对每一案件进行督办，把积案降低最小限度之内。通过建立和完善各项规章制度，使刑事审判工作科学运作，使审判人员的业务水平有了较大的提高。

　 6、打防并举，参与社会治安综合治理。我院在开展“严打”整治斗争的同时，坚持不放松刑事审判工作的各项任务，坚持打防并举，进一步落实社会治安综合治理措施，特别是进一步落实预防青少年犯罪的措施，认真做好未成年人的刑事审判工作，坚持寓教于审、惩教结合的方针，教育、挽救、感化失足青少年。每年四月份，我院均派出刑事审判人员前往省少管所探望失足少年，鼓励他们鼓起今后生活的勇气。同时由刑事审判人员出任慈城中心小学的法制副校长，为小学生送去书籍、VCD光盘，进行法制教育，取得良好的社会效果。同时为配合“严打”，还加强了“严打”斗争的宣传报道工作，通过以案说法、公开审判来积极开展法制宣传和普法宣传。

　 二、“严打”工作中存在问题和面临的困难

　 “严打”整治斗争开展一年多以来，虽然取得了一定的成绩与实效，但仍存在问题和不足，仍有一些困难尚需我们在今后的工作中加以解决：

　 1、案件的质量有待于进一步提高。自“严打”开展以来，共有 件案件被中院发回和改判。虽然在数量上与去年同期相比有较大的下降，但个别案件质量不尽人意是显而易见的，个别审判人员对定罪的证据掌握运用不够严格，尤其在当前“严打”形势下，错误地认为某些犯罪的证据运用可适当放宽，没有正确掌握“两个基本”，这是造成个别案件质量不高的重要原因。

　 2、案多人少的情况突出。从“严打”工作开展以来，共审结461件案件，刑庭现有包括庭长在内5名审判人员，其中2名审判长，1名独任审判员，随着一些疑难复杂案件的出现，以及严打斗争的不断深入开展，大量刑事案件将诉到法院，法院严打任务更加繁重，案件的审理难度加大，现有的审判力量已无法适应新形势的需要。

　 3、刑事案件的罚金刑难以执行到底。99年以来适用罚金刑的刑事案件有117件，应执行标的金额为60万元，而实际执行47件，标的金额仅13万元，执行完毕的尚不足20%，限于现有的审判力量和物资装配，不可能对罚金刑进行彻底的执行。再者有些犯罪分子流窜作案，被判刑服刑后或回原籍或不知去向，判处的罚金刑根本难以执行到底。

　 4、“严打”整治斗争经费紧张，刑事审判工作硬件设施较简陋。现仅有的一个刑事审判庭明显偏小，交通工具等硬件也无法满足日常工作的需要，给提高办案效率，加快办案速度带来了较大的困难。

　 三、下阶段“严打”整治斗争的基本思路

　 “严打”整治斗争现已取得阶段性成果，但社会治安形势依然严峻，斗争仍很复杂，全院干警树立了长期作战的思想，克服麻痹松懈和厌战情绪，始终坚持“严打”方针不动摇，严厉打击刑事犯罪分子，下阶段要具体做好以下几方面工作：一是要继续贯彻“严打”方针，继续从重从快地打击各类刑事犯罪，对重大疑难案件，及时介入到公安、检察的侦查、起诉过程中，及早与公安、检察联系，了解情况，熟悉案情，为今后顺利审结疑难案件打下基础。二是继续保持“严打”的高压势态，选择典型案例，在今年下半年召开1至2次公判大会，起到震慑犯罪、教育群众的作用。三是继续抓好清理未结案工作，对现有的未结案进行一次全面清理，发挥庭长督办催办的功能，使未结案尽快结案，尽量缩短办案周期，并且把未结案的总数控制在平常一个月的工作量的范围之内，到年底力争把未结案降到最低限度。四务求司法公正，在案件质量和办案效率上有明显突破，严格审限管理，进一步强化刑事审判人员的审限意识，不折不扣地执行案件审限的规定，同时加强对刑事案件质量的自查工作，深刻反思在办案中的各种缺点和失误，要以高度的责任感来办好每一件案件。五是继续抓好刑事审判的队伍建设，以抓作风建设、法官职业道德建设入手，按照“三个德化于”的要求，不断改善工作作风，提高职业道德素质。通过正反两方面的典型材料，加强干警的反腐倡廉教育，杜绝违法违纪事件的发生。同时抓好干警的业务培训，鼓励刑事审判人员参加学历教育，并以集中培训和专门培训相结合，扩大培训范围，保证学习时间和学习质量，使刑事审判人员在思想和业务上都有一个质的飞跃。六是进一步落实社会治安治理的各项措施，把重点放在青少年犯罪的预防上，并重点对青少年罪犯进行及时回访、教育、挽救失足青少年。
