　 党政领导干部辞职暂行规定

　第一条 为建立健全党政领导干部辞职制度，加强对党政领导干部的管理和监督，根据《党政领导干部选拔任用工作条例》和有关法律、法规，制定本规定。

　　第二条 党政领导干部辞职包括因公辞职、 自愿辞职、引咎辞职和责令辞职。

　　第三条 本规定适用于中共中央、全国人大常委会、国务院、全国政协、中央纪律检查委员会的工作部门或者机关内设机构的领导成员，最高人民法院、最高人民检察院的领导成员和内设机构的领导成员；县级以上地方各级党委、人大常委会、政府、政协、纪委、人民法院、人民检察院及其工作部门或者机关内设机构的领导成员；上列工作部门的内设机构的领导成员。

　　第四条 党委及其组织部门，按照干部管理权限履行本规定中的有关职责，负责本规定的组织实施。

　 第二章 因公辞职

　 第五条 领导干部担任由人大、政协选举产生的领导职务，任期未满因工作需要变动职务，依照法律或者政协章程规定应当辞去现任领导职务的，向本级人民代表大会、人大常委会或者政协提出辞去现任领导职务。

　　第六条 领导干部因公辞职，应当在接到党委通知后7日内， 向任免机关提出辞去现任职务的书面申请。

　　第七条 因公辞职的领导干部另有任用，按照有关法律规定拟任职务与现任职务不能同时担任的，应当在任免机关批准其辞职后，再对外公布其新任职务。

　 第三章 自愿辞职

　 第八条 党政领导干部因个人或者其他原因，可以自愿提出辞去现任领导职务或者公职。

　　第九条 党政领导干部自愿辞职应当经过下列程序：

　　干部本人按照干部管理权限， 以书面形式向党委提出辞职申请。辞职申请应当说明辞职原因等情况，同时辞去公职的还应说明辞职后去向等。

　　组织部门对干部辞职原因、辞职条件等有关情况进行了解审核，并提出初步意见。审核中应当听取干部所在单位的意见及纪检机关的意见，并与干部本人谈话。

　　按照干部管理权限，党委集体研究，作出同意辞职、不同意辞职或者暂缓辞职的决定。对申请辞去领导职务同时辞去公职的，党委除对是否同意其辞去领导职务作出决定外，还应对是否同意其辞去公职作出决定。

　　党委作出同意辞职决定后，按照有关规定办理辞职手续。由人大、政协选举、任命、决定任命的领导干部，依照法律或者政协章程的有关规定办理。

　　第十条 党委应当自接到干部辞职申请之日起三个月内予以答复。答复意见应当以书面形式通知辞职干部所在单位和干部本人。超过三个月未予答复的，视为同意辞职。

　　第十一条 党政领导干部有下列情形之一的，不得辞去领导职务：

　　有重要公务尚未处理完毕，而且须由本人继续处理的；

　　由人大、政协选举、任命、决定任命的领导干部任职不满一年的；

　　正在接受纪检机关、司法机关调查或者审计机关审计的；

　　有其他特殊原因的。

　　第十二条 党政领导干部具有本规定第十一条所列情形之一的或者有下列情形之一的，不得辞去公职：

　　在涉及国家安全、重要机密等特殊职位上任职或者离开上述职位不满解密期限的；

　　未满最低服务年限的；

　　有其他特殊原因的。

　　第十三条 党政领导干部辞去公职后三年内，不得到原任职务管辖的地区和业务范围内的企业、经营性事业单位和社会中介组织任职；不得从事或者代理与原工作业务直接相关的经商办企业活动。

　 第四章 引咎辞职

　 第十四条 党政领导干部因工作严重失误、失职造成重大损失或者恶劣影响，或者对重大事故负有重要领导责不宜再担任现职，本人应当引咎辞去现任领导职务。

　　第十五条 党政领导干部有下列情形之一的，应当引咎辞职：

　　因工作失职，引发严重的群体性事件，或者对群体性、突发性事件处置失当，造成严重后果或者恶劣影响，负主要领导责任的；

　　决策严重失误，造成巨大经济损失或者恶劣影响，负主要领导责任的；

　　第十六条 党政领导干部引咎辞职应当经过下列程序：
